This agreement is between you and nemosbackyard ("the site", "we", "us"). By creating an account or using the site you agree to this agreement, the Community Rules and the Privacy Policy. If you don't agree, please don't use the site.
nemosbackyard is a posting board. Members post listings for Party Animals merchandise and contact each other through on-site messages. We are not a party to any sale, not a broker, not a payment processor and not a shipping service. We do not handle payments, offer escrow, ship items, issue refunds or resolve disputes. Every transaction is arranged and completed directly between members, at their own risk.
We do not verify members' identities, inspect items for authenticity, or guarantee that any listing is accurate. "Asking price" on a listing is for reference only.
You must be at least 18 years old to use the site. If you are 13–17, you may only use it with the permission and supervision of a parent or guardian, who is responsible for your activity. Nobody under 13 may use the site.
You need a valid email address and a strong password; sign-ins from a new browser are confirmed by an emailed code, and you can add an authenticator app for extra protection. You are responsible for everything that happens under your account. Keep your password and backup codes safe. If you think your account has been compromised, use "Log out everywhere", change your password, and contact us. One account per person; accounts may not be transferred or shared.
You own the listings, photos and messages you post. By posting, you give us a non-exclusive, royalty-free, worldwide licence to store, display and transmit that content on the site, which is what we need to run it. You confirm you have the right to post what you post and that it doesn't infringe anyone else's rights.
We may remove any content without notice, including anything we believe breaks the rules, is unlawful, or is harmful.
In addition to the Community Rules, you may not: attack, probe or interfere with the site; scrape or bulk-collect member data; bypass security or access controls; impersonate another person or the site; or use someone else's account without authorisation.
We may warn, restrict, suspend or disable your account and remove content at any time, and may notify affected parties or law enforcement where appropriate. You can delete your own account at any time from the Security page.
"Party Animals" and its characters, logos and artwork belong to Recreate Games. nemosbackyard is fan-run and is not affiliated with or endorsed by Recreate Games. The site's name, design and code belong to its operator. If you believe content on the site infringes your intellectual property, email [email protected] with the specific content, the basis of your claim and your contact details, and we will act promptly.
The site is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, availability or freedom from errors. We make no warranty about any listing, member or transaction.
To the fullest extent permitted by law, nemosbackyard and its operator are not liable for any indirect, incidental, special, consequential or punitive damages, including but not limited to lost money, lost data, being scammed, receiving counterfeit goods or not receiving goods at all. Our total liability to you, if any, will not exceed the amount you have paid us in the previous 12 months (currently nothing).
You agree to defend and indemnify the site and its operator against any claims, losses or costs arising from your content, your transactions, or your breach of this agreement.
We may update this agreement. Significant changes will be announced on the site. Continuing to use the site after a change means you accept the new version.
This agreement is governed by the laws of the jurisdiction where the site's operator resides. If any part of it is found unenforceable, the rest still applies.
